1. Eligibility The Intermix $1,000 InStyle Sweepstakes (the "Sweepstakes") is open only to legal residents of the continental United States, Alaska and Hawaii, EXCEPT residents of Rhode Island, who are over the age of 21 at the time of entry and who are "Authorized account Holders" of their own Internet e-mail address (as defined below) as of April 1, 2009. An "Authorized Account Holder" is defined as the natural person to whom an e-mail address is assigned by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Employees and other representatives of Intermix, Inc. ("Intermix"), its affiliates, and advisors (and the immediate family members of each of them), and residents of any territory not listed above are not eligible to win. All applicable federal, state, and local laws and regulations apply. Void in Rhode Island, Puerto Rico and where prohibited. Intermix can accept only those entries that are completed and submitted in the format designated below.
2. Entries To enter, you must, between 12:01 a.m. Eastern time on October 19th, 2009 and 11:59 pm EST on November 30th, 2009. (the "Sweepstakes Period"), InStyle banner ad and complete the Sweepstakes entry form by entering your email address, your name, your birthday and your zip code. Limit one entry per person. All entries and other materials submitted to INTERMIX in connection with the Sweepstakes (collectively, "Entry Materials"), along with all associated copyright and other proprietary rights, become the property of INTERMIX upon submission, and Entry Materials will not be returned to any entrant. In the event of a dispute concerning who submitted an entry, the entry will be deemed to have been submitted by the Authorized Account Holder of the e-mail account of the e-mail address provided on the entry.
INTERMIX is not liable or responsible for: (a) any late, lost, misrouted, garbled, postage due, distorted, or damaged transmissions or entries; (b) mail, telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Sweepstakes disruptions, injuries, losses, or damages arising out of your participation in Sweepstakes; or (d) any printing or typographical errors in any materials associated with this Sweepstakes.
3. Prize One (1) GRAND PRIZE: $1,000 gift card - redeemable at any Intermix store location or www.intermixonline.com. (Total approximate retail value (ARV): $1,000)
The Grand Prize is not transferable or substitutable for cash or other prizes, except that Sponsor reserves the right in its sole discretion to substitute each prize for a prize of equal or greater value.
4. Selection of Winners A total of one Prize winner ("Prize Winner") will be determined by a random drawing ("Drawing") on or about November 30th, 2009. *The odds of winning depend on the number of eligible entries received.
5. Notification of WinnersINTERMIX will attempt to notify selected winners by e-mail and/or telephone on or about the next day after the Drawing. Prize Winners will have seven (7) days from notification to respond to the e-mail and/or telephone call. If a Prize Winner is unreachable or ineligible, fails to respond to the notification as provided above, or fails to claim a Prize in the manner prescribed in the winner notification, the winner will forfeit his or her Prize and a new winner will be selected.
6. General Release By entering the Sweepstakes, you release INTERMIX and each of its affiliated companies, and each of their directors, officers, employees, representatives, and agencies, from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession, or use of any Prize (including, without limitation, claims, costs, injuries, and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). By accepting any Prize, entrants consent to the use of their name, address, likeness, and/or Prize information for promotional and other purposes without further compensation, except where prohibited by law.
As a condition of being awarded any Prize, the Prize Winner will be required to sign an Affidavit of Eligibility and Compliance with these Rules and a Liability and (unless prohibited) Publicity Release consenting to the use of his or her name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation, and/or an address verification. Failure by potential Prize Winner to return any requested documents within five (5) business days after such documents are sent to the address provided by the potential Prize Winner, or the return of such documents or the Prize as undeliverable may result in disqualification and selection of an alternate winner, at the sole discretion of Sponsor. All decisions of Sponsor are final. You are not a winner until your submissions are validated.
7. ConditionsBy entering, each entrant (a) agrees to be bound by these rules and the judge's decisions and to comply with all federal, state and local laws and regulations; (b) that the entry becomes the INTERMIX's property and will not be returned; and (c) that United States law shall apply exclusively to the Sweepstakes and that any dispute with respect to the Sweepstakes shall be resolved in either the federal or state courts located in the State of New York.
8. Use of Entrants' Personal Information The information that entrants provide in connection with the Sweepstakes may be used for INTERMIX's internal purposes and to send entrants information about INTERMIX's products, but will not be provided to third parties, except as necessary for the administration of the Sweepstakes or as required by law or legal process. If an entrant does not wish INTERMIX to send him or her information about INTERMIX's products, entrant may contact customer service at customerservice@intermixonline.com.
9. Winners List and Official RulesTo obtain a Winners List, send a request (along with a self-addressed, stamped envelope) to INTERMIXONLINE.COM InStyle SWEEPSTAKES, Attn.: Winners, 48 W. 25th Street, 11th FL, New York, NY 10010. Winners List requests must be received within 60 days of the termination of the Sweepstakes Period. 10. GeneralEntrants agree to be bound by these Official Rules and by the decisions of INTERMIX, which are final and binding in all respects. To the maximum extent permitted by applicable law, INTERMIX reserves the right to change these rules or cancel the Sweepstakes at any time, in its sole discretion. If this Sweepstakes is not capable of running as planned, including without limitation, because of tampering, unauthorized intervention, fraud, or other cause beyond INTERMIX's control which corrupts or threatens to corrupt or adversely affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, INTERMIX reserves the right, in its sole discretion, to cancel, suspend and/or modify the Sweepstakes, and INTERMIX, in its sole discretion, can perform the random drawing from among all the eligible entries received prior to such cancellation, suspension or modification of the Sweepstakes.
Entrants who violate these Official Rules, tamper with the operation of the Sweepstakes, or engage in any conduct that is detrimental or unfair to INTERMIX, the Sweepstakes, or any other entrant (in each case, as determined in INTERMIX's sole discretion) are subject to disqualification from entry into the Sweepstakes. INTERMIX reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Sweepstakes.
